Why cant I get past the emergency call mode? Also, it is updated to 3.1.2 firmware

Your iPhone is locked to the At&t network. You would have to unlock it yourself to use it on T-mobile. Unfortunately, neither At&t or Apple (NSDQ: AAPL) will assist you to do that.
