Default I found a black iphone 3g 8gb at the mall a few days ago.Can I use it?
There was a sim card but it was laying on the ground next to the phone in a lot of little pieces.there is nothing on the phone at all.If i jailbreak it and put my sim card in it, could i get in any trouble?

I'd suggest trying to locate the owner first, you might want it back if it was your phone lost. If you try and can't locate them then I suppose you can jailbreak and use.

jailbreaking an iphone will cause the phone to "brick" making it unuseable, Apple (NSDQ: AAPL) has some sort of special block on hacking/jailbreaking. go to ATT and get an ATT sim card.
the iphone isnt that great anyway. it was kinda cool for a lil bit, but it lacks a lot. i upgraded to the htc fuze and i love it so much more.
