no you dont, unless the person selling it is already on a contract
to have a phone on a contract usually you need to buy it from the store

go to
craigslist.com
and look there, there should be sellers of razrs close to you to avoid buying on ebay

Well if you want to use it, yes. If not, then you are just buying the phone but it won't let you call anyone since it has no service.
